1、劳动者在该用人单位连续工作满十年的.此项是属于我国《劳动法》第二十条第二款“劳动者在同一用人单位连续工作满十年以上,当事人双方同意续延劳动合同的,如果劳动者提出订立无固定期限的劳动合同,应当订立无固定期限的劳动合同,”在我国劳动部《关于实行劳动合同制度若干问题的通知》和劳动部《关于贯彻执行〈劳动法〉若干问题的意见》中都做了相应的规定.如《劳动部关于贯彻执行〈劳动法〉若干问题的意见》第二十二条规定“‘在同一用人单位连续工作满十年以上’是指劳动者与同一用人单位签订的劳动合同的期限不间断达以十年”,满足此条件时,只要劳动者提出签订无固定期限的劳动合同,用人单位就应当与其订立无固定期限劳动合同.同时,依据1996年9月16日的《劳动部办公厅〈关于如何理解“同一用人单位连续工作时间”和“本单位工作年限”的请示〉的复函》,“‘同一用人单位连续工作时间’是指劳动者与同一用人单位保持劳动关系的时间”,“劳动者患病或非因工负伤,依法享有医疗期,因此在计算‘同一用人单位连续工作时间’时,不应扣除劳动者依法享有的医疗期时间”.本项规定是为了保护劳动者的利益,可以防止一些用人单位只使用劳动者的黄金工作年龄,在用完后即行辞退劳动者的这种不合理用工行为的发生,以保持劳动关系的相对稳定性.
2、用人单位初次实行劳动合同制度或国有企业改制重新订立劳动合同时,劳动者在该用人单位连续工作满十年且距法定退休年龄不足十年的.根据我国1996年10月31日劳动部《关于实行劳动合同制度若干问题的通知》中规定有“工作年限较长,且距法定退休年龄10年以内的”劳动者,如果其提出订立无固定期限劳动合同,用人单位应当与其订立.在满足劳动者在该用人单位连续工作满十年且距法定退休年龄不足十年的条件时可签无固定期限劳动合同,可以理解为是初次实行劳动合同制度或者国有企业改制重新订立劳动合同时,对老职工的照顾.3、连续订立二次固定期限劳动合同且劳动者没有我国劳动合同法第三十九条和第四十条第一项、第二项规定的情形.我国劳动合同法第三十九条规定了用人单位因劳动者的违法或违约行为而解除劳动合同的情形,如劳动者严重违反用人单位规章制度或被依法追究刑事责任.当劳动者不具有此条规定的情况时,用人单位又与劳动者连续订立二次固定期限劳动合同,证明用人单位对该劳动者的工作技术有一定程度的肯定,双方通过多次合作,已经建立了一种信赖关系,合同的续订也是这种信赖关系延续的表现.劳动合同法第四十条第一项、第二项亦规定了在劳动者患病或因工负伤后不能从事原工作和另行安排的工作的情形和不能胜任工作的情形下,用人单位可以解除劳动合同而不再续订原合同.
从保护劳动者权益,维护劳动关系稳定的角度,我国劳动合同法第十四条规定用人单位自用工之日起满一年不与劳动者订立书面劳动合同的,视为用人单位与劳动者已订立无固定期限劳动合同.
